Key gaffer on “Rust” is now taking legal action against Alec baldwin, Hannah gutierrez-reed and Dave hall … pursue them for the deadly shootout that killed Halyna Hutchins.
Serge Svetnoy just filed a lawsuit against the aforementioned – as well as others – claiming that the accused’s alleged negligence caused him severe emotional distress as a result of all of this.
According to documents, obtained by TMZ, Svetnoy claims the ball that struck both Hutchins and the director Joel Souza it actually zoomed in and almost touched it too. Not only that, but the gaffer claims he was one of the first people to deal with Halyna as she was bleeding profusely… trying to comfort her and keep her conscious.
As to why he is suing Baldwin, the prosecution claims he “had a duty to the plaintiff and the other crew members and actors on the set of ‘Rust’ to handle the Colt revolver provided to him by the defendant. Halls with reasonable care and diligence for the safety of The cast and crew of ‘Rust’. ” He goes on to say: “This obligation required the accused Baldwin to recheck the Colt revolver with Halls while handling it to make sure it did not contain live ammunition.”
And, it continues … “This duty called him even more [Baldwin] to handle the Colt Revolver as if it was loaded and not to point it at anyone. In other words, the lawsuit blames Baldwin’s negligence.
And, there is this… according to the lawsuit, the scene Baldwin was rehearsing did not invite him to pull the trigger. According to the lawsuit, the scene required Baldwin to draw the gun and point it in the general direction of the camera, but “the scene did not call for the accused Baldwin to fire the Colt revolver.”
The lawsuit also claims that Baldwin was negligent as a producer on “Rust”, saying: “… there were other shortcomings on set, including violation of industry standards, denial of requests for weapons training days, not allowing sufficient time to allow firing, failing to issue security bulletins, and dispersing personnel too much.
The prosecution also claims that the practice of target shooting which took place shortly before the tragedy was “scandalous”.
Svetnoy says he had known Halyna for 5 years and considered her a good friend.
The ordeal was absolutely traumatic, Svetnoy says, and has since left him in complete mental anguish… to the point where he feels he may never be able to get over it.
Svetnoy is asking for damages and a jury trial.
