The police officer who allegedly deleted witness video – as his body camera rolled, no less – is now facing prosecution over the incident.
The Philly Cop – identified in costume as Officer Burnett – just got slapped with a lawsuit by Jacob Giddings … The guy who claims his footage was cleaned up in March as Burnett tried to arrest him on an arrest warrant.
According to the lawsuit, obtained by TMZ, Giddings says he was pumping gasoline when Burnett passed his tags, identifying Giddings as someone who had an arrest warrant against him. While Giddings was in his vehicle, he says Burnett approached him from outside… asking him to get out of the vehicle without explanation.
Things would have escalated from there. Giddings claims Burnett started trying to force him out of the car. BTW, Giddings says he had started recording on his phone at this point… feeling uncomfortable about it all.
After much fighting – and the arrival of a 2nd officer – Giddings says he surrendered, was handcuffed and placed in the back of a police car.
Giddings says Burnett then searched his car and found the phone that had recorded. Giddings makes an explosive statement – he says Burnett crashed his phone, along with Giddings’ own vehicle, in an attempt to destroy the evidence!
Giddings claims that after realizing that the phone was ALWAYS recording and that it was not destroyed at all, Burnett then took it upon himself to delete the video – only to play the idiot when Giddings told him asked if she was still there. He is suing for assault, bodily harm, excessive force and unlawful search and seizure.
Of course, Giddings says that Burnett’s own body-cam was rolling While Giddings is saying, this is the moment he tried to get rid of the evidence… and Giddings insists that it is the smoking gun that proves his case.
Lucky for Giddings … he says he was able to recover the allegedly deleted clips, and now – he’s asking for damages. Meanwhile, the ministry says it is investigating this case internally and the cop in question here has been put on leave.
