Bill Cosby is a free man, but prosecutors are asking the country’s highest court to review his case … claiming he has never enjoyed the immunity of a PA prosecutor Andrea Constand Case.
According to new legal documents obtained by TMZ … Pennsylvania prosecutors are asking the United States Supreme Court to review the PA Supreme Court’s decision that overturned Cosby’s conviction – leading to his immediate release from jail.
Remember, Cosby walked freely in June after serving over 2 years of a 10-year sentence in his sexual assault case. The PA Supreme Court ruled that the conviction was false because Cosby had relied on an agreement with a former prosecutor not to indict him criminally when he was filed in the Constand case.
In new documents, prosecutors ask the United States Supreme Court to rectify what they say is “grave wrong”, arguing that overturning Cosby’s conviction is a slippery slope that could set a dangerous precedent .
They insist Cosby was not granted lifetime immunity from prosecution simply because the former prosecutor refused to indict him criminally at the time.
The call is a bit of a Hail Mary from the prosecutors. The United States Supreme Court hears less than 1% of applications, but there is still a chance… even slim.
Cosby spokesperson, Andrew Wyatt, tears up prosecutors over the appeal, saying the prosecutor’s office is “unwilling to accept its epic loss” and calls it “a pathetic effort of last resort that will not prevail.”
